Terms & Conditions
Last Updated: August 25, 2026
These Terms & Conditions ("Terms") govern your access to and use of the Serotonin Studio website, digital products, services, and related content.
Serotonin Studio is operated by Serotonin Studio LLC ("Serotonin Studio," "we," "us," or "our"). By accessing our website, purchasing or downloading a product, or otherwise using our services, you agree to be bound by these Terms, including the License Terms applicable to our digital products.
Please read these Terms carefully before using our website or purchasing a product. If you do not agree to these Terms, you may not access or use our services or digital products.
Our digital products are licensed, not sold. Your purchase grants you certain usage rights under the license selected at the time of purchase. Ownership of the underlying product, photography, and other Serotonin Studio intellectual property remains with Serotonin Studio unless expressly stated otherwise.
1. Online Store Terms
By using this website, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.
You may not use our website, products, or services for any unlawful or unauthorized purpose, or in any way that violates applicable laws or regulations.
You may not attempt to interfere with the operation or security of the website, gain unauthorized access to any part of the website or its systems, or transmit malicious code, viruses, or other harmful material.
We reserve the right to refuse service, cancel orders, or restrict access to our website or products where we reasonably believe these Terms have been violated, fraud or unauthorized activity has occurred, or our products or services are being misused.
2. Products & Digital Downloads
Serotonin Studio sells digital products, including Photoshop mockup files, collections, guides, and other digital design assets. No physical products will be shipped unless expressly stated otherwise.
Product descriptions, previews, specifications, compatibility information, and other details are provided on the applicable product page. We make reasonable efforts to present our products accurately, but colors, appearance, and performance may vary depending on your device, display, software, and individual workflow.
You are responsible for ensuring that you have the software, hardware, and technical ability required to use a product before purchasing it. Unless otherwise stated, Serotonin Studio mockups are designed for use with Adobe Photoshop. Compatibility with third-party software, applications, or future software versions is not guaranteed.
Access to purchased digital products is provided through the download or delivery methods available at the time of purchase. You are responsible for maintaining your own copies of downloaded files. We do not guarantee that purchased products will remain available for re-download indefinitely.
Purchasing or downloading a digital product does not transfer ownership of that product or its underlying intellectual property. All digital products are licensed subject to the applicable License Terms set out below.
3. Purchases & Payment
All prices are displayed in the currency shown at checkout and are subject to change at any time. Any price change will not affect an order that has already been completed.
By placing an order, you agree to provide current, complete, and accurate purchase and billing information. You represent that you are authorized to use the payment method provided for the purchase.
Payment is due at the time of purchase and must be successfully processed before access to paid digital products is provided.
Applicable taxes may be calculated and collected at checkout based on your location and applicable law.
We reserve the right to refuse, cancel, or limit an order where we reasonably believe it involves fraud, unauthorized payment activity, pricing or technical errors, misuse of our products, or a violation of these Terms. If we cancel an order after payment has been successfully processed, we will refund the applicable amount unless we are legally entitled to withhold it.
Purchases of digital products are also subject to our Refund Policy, which forms part of these Terms.
4. License Terms
4.1 General License Grant
All Serotonin Studio digital products are licensed, not sold. When you purchase or otherwise lawfully obtain a Serotonin Studio product, you receive a limited, non-exclusive, non-transferable, and non-sublicensable right to use that product according to the license applicable to your purchase and these Terms.
Unless otherwise stated, licenses are worldwide and perpetual, provided that you continue to comply with these Terms.
Purchasing a license does not transfer ownership of the product, original photography, source files, or any other intellectual property belonging to Serotonin Studio.
The license tier required for commercial use is determined by the size of the end-user entity benefiting from that use, not simply by the person or company that purchases the product.
For products sold as packs or collections, the applicable license covers all individual assets included in that pack or collection under the same license scope. For Commercial and Commercial Plus licenses, all included assets may be used within the same licensed project or campaign.
4.2 Portfolio License
The Portfolio License permits use of a product for presenting, showcasing, and pitching creative work. There is no company-size restriction for uses permitted under the Portfolio License.
Permitted uses include:
- Personal and self-initiated projects
- Portfolios and case studies
- Personal websites
- Client pitches and presentations
- Internal presentations
- Organic, non-paid social media
- Student and academic projects
- Design award submissions
- Other comparable non-commercial presentation uses
The Portfolio License does not permit use of the product in paid advertising, e-commerce, marketing campaigns, commercial promotions, or other final commercial applications on behalf of a business, brand, product, or service.
Work originally created for a commercial client may be displayed under the Portfolio License when the mockup is being used solely to present or showcase that work and is not being used by or on behalf of the client for a commercial purpose.
Portfolio use is not limited to a specific number of projects or presentations.
4.3 Commercial License
The Commercial License permits use of a product for commercial projects where the applicable end-user entity has 1–20 employees.
It includes all uses permitted under the Portfolio License, as well as:
- Client commercial work
- Business and brand projects
- Paid advertising and sponsored content
- Marketing and promotional campaigns
- Commercial websites and e-commerce
- Commercial social media
- Print and digital advertising
- Other comparable commercial applications
Each Commercial License covers one commercial project or campaign for one end-user entity.
A separate Commercial License is required when the same product is used for a different commercial project, campaign, or end-user entity.
4.4 Commercial Plus License
The Commercial Plus License provides the same usage rights as the Commercial License for commercial projects where the applicable end-user entity has 21–50 employees.
Each Commercial Plus License covers one commercial project or campaign for one end-user entity.
A separate Commercial Plus License is required when the same product is used for a different commercial project, campaign, or end-user entity.
4.5 Enterprise Licensing
Commercial use by an end-user entity with more than 50 employees requires an Enterprise License.
An Enterprise License may also be required where the intended use falls outside the scope of the standard licenses described in these Terms.
Enterprise licenses are provided on a custom basis and may include additional or modified usage rights, restrictions, pricing, or other terms agreed upon in writing between Serotonin Studio and the applicable licensee.
Portfolio uses otherwise permitted under Section 4.2 do not require an Enterprise License solely because the organization associated with the work has more than 50 employees.
4.6 End-User Entity and Company Size
For purposes of determining the appropriate license for commercial use, the end-user entity is the business, brand, company, organization, or other entity that ultimately uses or benefits from the final commercial work.
When a freelancer, designer, studio, agency, contractor, or other third party purchases a product for work performed for a client, the required license tier is determined by the size of the client or other end-user entity benefiting from the commercial use, rather than the size of the purchaser.
For example, a freelance designer working alone who creates a commercial campaign for a company with 30 employees requires a Commercial Plus License for that project.
Company size is determined by the total number of employees of the applicable end-user entity at the time the licensed product is first used for the commercial project or campaign.
4.7 Projects and Campaigns
For Commercial and Commercial Plus licenses, a project or campaign means a single, cohesive body of work created for one end-user entity around a common creative purpose, product, service, brand initiative, or campaign.
A single project or campaign may include multiple related deliverables and media placements, including digital, social, web, e-commerce, advertising, presentations, and print, provided they are part of the same underlying project or campaign.
Using the same Serotonin Studio product for a separate client, unrelated campaign, unrelated product launch, or substantially separate commercial initiative requires a new applicable license.
Minor revisions, adaptations, resizing, localization, or extensions of the same underlying project do not by themselves create a new project or campaign.
4.8 Client Work and Delivery
Commercial and Commercial Plus licenses permit designers, freelancers, studios, agencies, and other service providers to create finished work for clients within the scope of the applicable license.
Finished, non-editable outputs created using a Serotonin Studio product may be delivered to the applicable client. Examples include flattened JPG, PNG, PDF, video, or other non-editable final output formats.
The original Serotonin Studio product, PSD file, Smart Object, layered file, or any other editable file containing or providing access to Serotonin Studio assets may not be transferred, shared, sublicensed, or delivered to a client or other third party.
If a client wishes to access or use the original or editable Serotonin Studio product independently, the client must obtain its own appropriate license.
4.9 Prohibited Uses
Unless expressly authorized by Serotonin Studio in writing, no license permits you to:
- Resell, redistribute, share, sublicense, or otherwise make the original product available to another person or entity
- Upload or distribute the product through stock libraries, marketplaces, template platforms, asset libraries, file-sharing services, or similar platforms
- Include the product or an editable version of it in another product, template, download, or asset intended for distribution or resale
- Share or deliver PSD files, Smart Objects, layered files, or other editable Serotonin Studio assets to clients or third parties
- Use a Serotonin Studio product to create a competing mockup, template, stock asset, or substantially similar digital asset product
- Remove or circumvent technical measures intended to protect or control access to a product
- Claim ownership or authorship of the underlying Serotonin Studio product, photography, or other original assets
- Register or attempt to register any Serotonin Studio product or underlying asset as your own intellectual property
- Use the product in a manner that violates applicable law or the rights of another person or entity
These restrictions apply regardless of whether the prohibited activity is performed for free or for compensation.
4.10 Artificial Intelligence and Machine Learning
Serotonin Studio products may be edited using AI-assisted features as part of a normal creative workflow, including tools used for retouching, object removal, background extension, color correction, or similar modifications to a licensed project.
You may not use Serotonin Studio products, original photography, preview images, source files, or other underlying assets:
- To train, fine-tune, test, or develop an artificial intelligence or machine-learning model
- As part of a training dataset, image dataset, embedding, LoRA, retrieval corpus, or similar machine-learning resource
- For the purpose of generating, recreating, reproducing, replicating, or developing competing mockups, stock imagery, templates, photographs, or other digital assets based substantially on or derived from Serotonin Studio products, original photography, or preview images
Nothing in this section prohibits ordinary AI-assisted editing of a properly licensed product for an otherwise permitted use.
4.11 License Compliance, Verification, and Termination
You are responsible for ensuring that your use of Serotonin Studio products remains within the scope of the license you purchased.
If we reasonably believe that a product is being used outside the scope of an applicable license, has been redistributed without authorization, or is otherwise being used in violation of these Terms, we may request reasonable information necessary to verify the applicable purchase and license.
If your intended use expands beyond the scope of your existing license, you must obtain the appropriate additional or upgraded license before continuing that expanded use.
Serotonin Studio may suspend or terminate license rights associated with a material violation of these Terms. Termination of a license does not transfer ownership of the product and does not limit any rights or remedies available to Serotonin Studio under applicable law.
Upon termination of a license for violation of these Terms, you must cease the unauthorized use and, where reasonably required, delete or remove copies of the affected Serotonin Studio product in your possession or control.
Serotonin Studio reserves the right to pursue appropriate remedies for unauthorized use, redistribution, infringement, or other material violations of these Terms.
5. Intellectual Property
All content made available through Serotonin Studio, including our digital products, original photography, mockups, graphics, branding, logos, website design, text, product previews, and other creative materials, is owned by or licensed to Serotonin Studio and is protected by applicable intellectual property laws.
Except for the limited rights expressly granted under these Terms and the applicable License Terms, no right, title, or interest in Serotonin Studio's intellectual property is transferred to you.
You may not copy, reproduce, distribute, modify, publish, sell, exploit, or otherwise use Serotonin Studio content except as expressly permitted under these Terms or with our prior written permission.
Any trademarks, product names, company names, logos, artwork, or other materials that you place into a Serotonin Studio mockup remain the property of their respective owners. You are responsible for ensuring that you have the necessary rights or permissions to use materials you add to our products.
6. Third-Party Services & Links
Our website and services may rely on or provide access to third-party platforms, applications, payment processors, download services, websites, or other services that are not operated or controlled by Serotonin Studio.
Your use of third-party services may be subject to separate terms and privacy policies established by those providers. We are not responsible for the availability, operation, content, security, or practices of third-party services outside our reasonable control.
Links to third-party websites or services are provided for convenience and do not necessarily constitute an endorsement by Serotonin Studio.
7. Prohibited Uses
In addition to the restrictions contained in the License Terms, you may not use our website, products, or services:
- For any unlawful or fraudulent purpose
- To violate or infringe the intellectual property, privacy, publicity, or other rights of another person or entity
- To transmit malicious code, viruses, or other material intended to interfere with the operation or security of our website or services
- To attempt to gain unauthorized access to our website, accounts, systems, or related infrastructure
- To collect, scrape, harvest, or misuse information from our website through automated or deceptive means
- To impersonate another person or entity or misrepresent your relationship with Serotonin Studio
- To circumvent security, access, purchasing, download, or licensing restrictions
We reserve the right to restrict or terminate access to our website, services, or products where we reasonably believe these Terms have been materially violated.
8. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Serotonin Studio website, digital products, and services are provided on an "as is" and "as available" basis.
We make reasonable efforts to provide high-quality, functional digital products and accurate information, but we do not guarantee that our website, products, or services will be uninterrupted, error-free, completely secure, or compatible with every device, software configuration, workflow, or future software version.
We do not guarantee that the use of our products will produce any particular creative, professional, commercial, or financial result.
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Serotonin Studio and its owners, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, our website, digital products, or services.
This includes, without limitation, loss of profits, revenue, business opportunities, data, goodwill, or other intangible losses, whether arising in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, Serotonin Studio's total aggregate liability arising from or relating to a particular product, purchase, or use of our services will not exceed the amount you paid to Serotonin Studio for the product or transaction giving rise to the claim.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
10. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Serotonin Studio, Serotonin Studio LLC, and their owners, employees, contractors, affiliates, and service providers from and against claims, liabilities, damages, losses, and reasonable costs or expenses arising from or related to:
- Your material violation of these Terms
- Your unauthorized or unlawful use of our products or services
- Materials, content, trademarks, artwork, or other intellectual property you use with our products
- Your infringement or violation of the rights of another person or entity
This obligation does not apply to the extent a claim results from the wrongful conduct of Serotonin Studio.
11. Termination
These Terms remain effective while you access or use our website, products, or services.
We may suspend or terminate your access to our services or applicable license rights if you materially violate these Terms, subject to applicable law.
Any provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, license restrictions, disclaimers, limitation of liability, indemnification, and governing law.
Termination does not affect rights or obligations that arose before the effective date of termination.
12. Governing Law
These Terms and any dispute arising from or relating to them will be governed by and interpreted in accordance with the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles, except where applicable law requires otherwise.
Nothing in these Terms is intended to limit any rights or protections available to consumers that cannot lawfully be waived or limited.
13. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or, where necessary, severed from these Terms.
The remaining provisions will continue in full force and effect.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes to our products, services, business practices, licensing structure, or applicable legal requirements.
When we make changes, we will update the "Last Updated" date at the top of this page.
Changes will apply prospectively from the effective date of the updated Terms unless otherwise required by law. A license validly granted under an earlier version of these Terms will not have its material usage rights retroactively reduced solely because we later update these Terms, unless required by applicable law or agreed to by the licensee.
Your continued use of our website or services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
15. Entire Agreement
These Terms, together with our applicable License Terms, Refund Policy, Privacy Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement between you and Serotonin Studio concerning your use of our website, products, and services.
If separate written terms have been expressly agreed between you and Serotonin Studio, including an Enterprise License, those specific written terms will control to the extent they conflict with these Terms.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it later.
